MAHARERA GRANTS ALL PROJECTS FOUR EXTRA MONTHS OVER WEST ASIA WAR

HPT INVESTIGATION DESK | MUMBAI The Maharashtra Real Estate Regulatory Authority has extended the completion timelines of eligible registered projects across the state by four months, citing disruption to global supply chains caused by the conflict in West Asia. The order was reported on 7 August 2026. The extension is not discretionary and not case-by-case. Any registered project whose original completion date, revised completion date or previously extended completion date falls on or after 28 February 2026 receives an additional four months automatically. MahaRERA has stated that promoters are not required to file a separate application to obtain the benefit, and the order directs the Authority's registration and IT cell to update its records and web portal to reflect the revised timelines. The statutory route matters and should not be flattened into 'supply chain trouble'. The Department of Expenditure, Ministry of Finance, by an Office Memorandum dated 29 April 2026, treated the West Asia situation as 'war' for invoking the force majeure clause. Section 6 of the Real Estate (Regulation and Development) Act, 2016 permits extension of a registration for force majeure, and war is expressly one of its grounds. On that classification the Union Ministry of Housing and Urban Affairs, by advisory dated 31 July 2026, advised State Authorities to grant a common four-month extension rather than require separate applications, also citing Section 7(3). For the MMR the effect is immediate. A project that was, on paper, in default from March 2026 may now be within time. What the order does not say matters equally. It is a regulatory extension of the completion date recorded with the Authority. It is not, on its face, an amendment of any individual agreement for sale, and it does not by itself extinguish a contractual possession date agreed between promoter and allottee under Section 13 of the Real Estate (Regulation and Development) Act, 2016.
