Supreme Court: Developer Cannot Walk Away From Redevelopment Promise After Taking Your Flat

In a ruling with direct bearing on every ongoing redevelopment project in the MMR, the Supreme Court has held that a Permanent Alternate Accommodation Agreement (PAAA) under the MHADA Act is statutory and enforceable by MHADA — not a private contract a developer can dispute years later. The case, Mrs. Mahabanoo Contractor and Anr. v. M/s. Kalikund Developers and Ors. (Civil Appeal No. 9342/2026, arising from SLP (C) No. 4498/2026, decided by Justices J.B. Pardiwala and K. Vinod Chandran; 2026 INSC 737), concerned redevelopment of a cessed building — Wimbridge Compound, Grant Road (West) — under an NOC issued by MHADA. The developer took vacant possession, demolished the old building, and built the new tower. Years later, after a change in its internal partnership, the new management refused to hand over three flats, disputing the occupant's status — despite the same occupant appearing in the developer's own public notice and MHADA's certified beneficiary list. The Bombay High Court had sided with the developer, restraining MHADA and holding the PAAA was a private arrangement outside writ jurisdiction. The Supreme Court reversed this: once a developer has taken possession and completed redevelopment on a PAAA's strength, it is estopped from later disputing occupant rights. It ordered flat handover within two months — with rental damages if delayed — and Rs 1,00,000 in costs. For MMR readers, the significance goes well beyond one Grant Road building: the Supreme Court has closed a loophole that redevelopment disputes across Mumbai and Thane have repeatedly tried to exploit — using a change of partners or a documentation dispute to walk back commitments once the building is gone and the new tower stands.
